THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991;
NOTING the oral decision of the Appeals Chamber of 19 April 1999, providing for a distinct sentencing procedure in the event that the Prosecution were to succeed in its appeal against some of the acquittals at trial;
NOTING the Judgement in Prosecutor v. Dusko Tadic, case no. IT-94-1-A, filed on 15 July 1999 ("Judgement");
NOTING that, in the Judgement, the Appeals Chamber deferred sentencing on the counts mentioned in sub-paragraphs (4) and (5) of the disposition to a further stage of sentencing proceedings;
NOTING the oral decision of the Appeals Chamber of 15 July 1999, that each Party may file a written brief by 25 August 1999 in respect of arguments on sentencing for the counts mentioned above;
HEREBY ORDERS that, in addition to matters mentioned during oral proceedings on 15 July 1999, the Parties are requested to address the following issue by 25 August 1999: whether the Appeals Chamber should remit to a Trial Chamber, and, if so, to which Trial Chamber, the question of sentencing the Appellant in respect of the counts on which the Appellant has been found guilty in sub-paragraphs (4) and (5) of the disposition in the Judgement.
